Litigation Support

Our I/O psychologists frequently serve as expert witnesses assisting both defendants’ and plaintiffs’ counsel in class-action employment discrimination lawsuits. We have frequently been selected as court appointed experts to design new programs as part of settlement agreements.

Our litigation support services include: evaluating whether HR processes are fair in design and implementation; determining whether a test or other employment procedure (e.g., a performance appraisal system) is valid and job related according to legal and professional guidelines and standards; memorializing findings and conclusions regarding validity evidence in expert reports; and testifying in court about expert opinions and conclusions.

As a result of class-action settlements, APT's President, Kathleen Lundquist, Ph.D., serves as a court-appointed expert in diversity measurement and the design and implementation of legally defensible HR processes for organizations such as Morgan Stanley, The Coca-Cola Company, Abercrombie & Fitch, Ford Motor Company and the Federal Bureau of Investigation.

Our HR process audit service helps client organizations provide consistent and fair treatment across all of its HR processes. We proactively assess areas where corporations can improve their HR processes to derive the most value from diverse talent. Our service ensures that internal practices are on track and aligned with strategic business goals while sustaining work environments that foster workplace equity. We work with your internal and external counsel and your HR department to make recommendations and implement improvements to your processes.
